The terms that apply when you visit or use KINSTILL.

Welcome to KINSTILL. These Terms of Service ("Terms") govern your access to and use of the KINSTILL website, including all free and premium content (collectively, the "Service"). By accessing or using the Service, you ("Visitor," "you") agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Description of Service

KINSTILL is a global information and parenting education service intended for parents of babies and young children worldwide, as well as caregivers and other adults responsible for their care or education. It provides articles and guides, both free and paid ("Premium"), focused on the early years of a child's life, from birth to 5 years, including but not limited to:

  • Infant and young child sleep
  • Feeding, breastfeeding, bottle-feeding, and introduction of solid foods
  • Psychomotor, emotional, and language development
  • Infant health and well-being
  • Stimulation, play, and age-appropriate activities
  • Potty training, daily care, and safety
  • Emotional regulation and parental well-being

The content is designed to support parents in their daily lives. It is provided for general informational and educational purposes only and does not replace medical, paramedical, or professional advice.

2. Eligibility

The Service is intended primarily for parents of young children worldwide, expectant parents, and adults responsible for a baby or young child. By using the Service, you represent that you are at least 18 years old, or the age of legal majority in your jurisdiction, or that you are accessing the Service under the supervision of a parent or guardian who agrees to these Terms on your behalf.

3. Pre-Contractual Information

In accordance with applicable consumer protection laws, including but not limited to Law No. 2010/021 of December 21, 2010 on Electronic Commerce in Cameroon, Framework Law No. 2011/012 of May 6, 2011 on Consumer Protection, and applicable international standards, the following essential information is provided to you before any contract is concluded:

  • Identity of the provider: KINSTILL, contactable at contact@kinstill.cc.
  • Price: Prices are displayed in US Dollars (USD). Where applicable, local currency equivalents may be shown for convenience; the contractual reference price is the price expressed in USD.
  • Accepted payment methods: PayPal, bank transfer (via Airtm US Virtual Account), Bitcoin, USDC, and Airtm balance transfer.
  • Fees: Any bank or cryptocurrency network transaction fees are your responsibility.
  • Right of withdrawal: You may have a right of withdrawal under applicable law, as detailed in Section 5.
  • Delivery: Premium content is accessible immediately after payment confirmation, electronically.
  • Complaints: Any complaint may be addressed to contact@kinstill.cc.

4. Payments and Pricing

  • Premium content is offered for a one-time fee, as displayed at the time of purchase.
  • We accept payment via PayPal, bank transfer (via Airtm US Virtual Account), Bitcoin, USDC, and Airtm balance transfer.
  • Reference price: The contractual price is set in US Dollars (USD). For cryptocurrency payments, the converted amount is displayed at checkout, with a maximum tolerance margin of ±2% to cover exchange rate fluctuations. The amount confirmed at checkout is final.
  • You are responsible for any transaction fees charged by your payment provider, bank, or cryptocurrency network.
  • All payments are processed by third-party payment providers. KINSTILL does not store your full payment card, bank, or wallet credentials.

5. Right of Withdrawal and Refunds

In accordance with applicable consumer protection laws, including but not limited to Law No. 2010/021 of December 21, 2010 on Electronic Commerce, Framework Law No. 2011/012 of May 6, 2011 on Consumer Protection, and applicable international standards:

  • Right of withdrawal: You have a period of 15 working days from the conclusion of the contract to exercise your right of withdrawal, without having to justify any reason and without penalty, or such longer period as may be required by mandatory law in your jurisdiction (for example, 14 days for consumers in the European Union).
  • Exception – Immediate access: If you expressly request immediate access to Premium content before the end of the withdrawal period, you acknowledge and agree that performance of the contract begins immediately. In that case, you expressly waive your right of withdrawal, in accordance with Article 15 of Law No. 2010/021. This waiver must be materialized by a separate checkbox during the payment process.
  • Downloaded digital content: In accordance with applicable regulations, digital content downloaded or unsealed directly by the consumer may be excluded from the right of withdrawal. However, this exclusion applies only if you have been fully informed and have consented to immediate performance.
  • Refund procedure: If you validly exercise your right of withdrawal, the refund will be made within 15 days following your request, using the same payment method used for the purchase, unless otherwise agreed.
  • Technical issues: If you experience a technical issue preventing access to purchased content, contact us at contact@kinstill.cc. We will make reasonable efforts to resolve the issue, including granting renewed access or, at our discretion, a refund.
  • Safeguard clause: Nothing in these Terms limits any mandatory rights you may have as a consumer under applicable law.

6. Data Protection and Privacy

KINSTILL complies with applicable data protection laws, including Law No. 2024/017 of December 23, 2024, on Personal Data Protection in Cameroon, and, where applicable, the General Data Protection Regulation (GDPR) of the European Union and the California Consumer Privacy Act (CCPA/CPRA).

6.1 Data We Collect

  • Email address (for account creation and communication)
  • Payment information (processed by third-party providers; we do not store full card or wallet credentials)
  • IP address and browsing data (for security, analytics, and fraud prevention)
  • Any information you voluntarily provide through contact forms

6.2 Legal Basis for Processing

Under the GDPR and Law No. 2024/017, we process your data on the following bases:

  • Performance of a contract: processing payments and delivering Premium content
  • Consent: for marketing communications and non-essential cookies
  • Legitimate interest: security, fraud prevention, and service improvement

6.3 Your Rights

  • Right of access: request a copy of the personal data we hold about you
  • Right to rectification: request correction of inaccurate data
  • Right to erasure: request deletion of your data, subject to legal retention obligations
  • Right to data portability: receive your data in a structured, machine-readable format
  • Right to object: object to processing based on legitimate interest
  • Right to withdraw consent: withdraw consent at any time for consent-based processing
  • Right to lodge a complaint: with the competent supervisory authority in your jurisdiction

6.4 California Residents (CCPA/CPRA)

  • You have the right to know what personal information is collected, used, or shared
  • You have the right to request deletion of your personal information
  • You have the right to opt out of the sale or sharing of your personal information
  • We do not sell your personal information
  • You will not be discriminated against for exercising your privacy rights

6.5 Cookies

We use essential cookies for site functionality and, with your consent, analytics cookies. You can manage your cookie preferences at any time.

6.6 Data Retention

We retain personal data only as long as necessary for the purposes described above or as required by law.

6.7 International Transfers

If you are located in the EEA or UK, your data may be transferred to and processed in countries outside those regions. We ensure appropriate safeguards are in place, including standard contractual clauses.

7. Intellectual Property, Copyright, and Author's Rights

7.1 Protection of the Site and Content

All elements of the Service — including, without limitation, texts, articles, guides, graphics, logos, interfaces, structure, source code, databases, and design — are the exclusive property of KINSTILL and/or its author, and are protected by:

  • Law No. 2000/011 of December 19, 2000 on Copyright and Neighboring Rights in Cameroon
  • The Berne Convention for the Protection of Literary and Artistic Works (to which Cameroon has been a party since 1964)
  • The WIPO Copyright Treaty (WCT) (acceded to by Cameroon on July 24, 2024)
  • The Bangui Agreement (OAPI)
  • The TRIPS Agreement of the World Trade Organization
  • Any other applicable intellectual property law

7.2 Author's Moral Rights

The author of the original content retains, in all circumstances, their moral rights over their works, in accordance with Law No. 2000/011 and applicable international conventions, including the Berne Convention. These rights are perpetual, inalienable, and imprescriptible. They include, among others:

  • The right of paternity: the right to be recognized as the author of the work
  • The right to respect for the integrity of the work: the right to object to any modification, distortion, or alteration of the work
  • The right of disclosure: the right to decide on the first communication of the work to the public
  • The right of withdrawal or repentance: the right to withdraw the work from commerce, subject to possible compensation

Any infringement of these moral rights, including any use without attribution, any unauthorized modification, or any distortion of the content, is strictly prohibited and may be subject to legal action in any jurisdiction where the infringement occurs.

7.3 Limited License to Visitors

Subject to compliance with these Terms, KINSTILL grants you a personal, non-exclusive, non-transferable, revocable, and strictly limited license to:

  • View and read the content for personal, non-commercial use.

This license does not grant you any ownership rights over the content. All rights not expressly granted are reserved to KINSTILL and/or its author.

7.4 Prohibited Uses

Without prior written consent from KINSTILL, you may not:

  • Reproduce, distribute, republish, sell, rent, lend, or commercially exploit all or part of the content, whether free or Premium
  • Share Premium content access, login credentials, or any purchased material with third parties
  • Scrape, copy, or use automated tools to extract content from the Service
  • Modify, adapt, translate, decompile, or create derivative works from the content
  • Remove or alter copyright notices, trademarks, or attribution notices
  • Circumvent technical protection measures or access restrictions

7.5 Enforcement and Remedies

Any violation of these intellectual property provisions may result in:

  • Immediate termination of your access to the Service, without refund
  • Civil and/or criminal legal action
  • A claim for damages for the harm suffered, including reasonable legal fees

7.6 Reporting Infringement

If you believe that any content on the Service infringes your copyright or moral rights, please contact us at contact@kinstill.cc and provide:

  • A description of the protected work
  • The location of the allegedly infringing content
  • Your contact information
  • A good-faith statement
  • A statement attesting to the accuracy of the information provided

8. Anti-Fraud, Anti-Scam, and Cybersecurity

KINSTILL complies with the Budapest Convention on Cybercrime (acceded to by Cameroon on May 23, 2022), the African Union Convention on Cyber Security and Personal Data Protection (Malabo Convention), and Law No. 2010/012 on Cybersecurity and Cybercriminality in Cameroon.

8.1 Prohibited Activities

  • Using KINSTILL's name, logo, brand, or content to impersonate, deceive, or defraud third parties
  • Sending phishing emails, fraudulent messages, or fake communications purporting to originate from KINSTILL
  • Using stolen payment credentials or engaging in any form of payment fraud
  • Creating fake accounts or misrepresenting your identity
  • Attempting to gain unauthorized access to any part of the Service, its systems, or other Visitors' data

8.2 Security Measures

  • All payments are processed through secure, third-party providers
  • We do not store full payment card, bank, or wallet credentials
  • We employ reasonable technical and organizational measures to protect our systems (encryption, access controls, multi-factor authentication)
  • We reserve the right to request identity verification for suspicious transactions

8.3 Reporting Fraud

If you suspect that you have been targeted by a scam involving KINSTILL, or if you become aware of any fraudulent use of our name or content, please report it immediately to contact@kinstill.cc.

8.4 Cooperation with Authorities

We cooperate with law enforcement authorities in investigating cybercrimes, including fraud, unauthorized access, and data breaches, in accordance with the Budapest Convention and applicable national laws.

8.5 Consequences

Any attempt to defraud KINSTILL or its users may result in:

  • Immediate termination of access
  • Reporting to relevant law enforcement and financial authorities
  • Civil and/or criminal legal action
  • Claims for damages, including legal fees

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service, its systems, or other Visitors' data
  • Interfere with or disrupt the Service or its servers
  • Impersonate any person or misrepresent your affiliation with KINSTILL

We reserve the right to suspend or terminate access for any Visitor who violates these Terms.

10. No Professional or Medical Advice

Content on KINSTILL, whether free or Premium, is provided for general informational and educational purposes only. It does not constitute medical, psychological, or professional advice and should not replace consultation with a qualified healthcare provider. Use of the Service does not create a doctor-patient relationship or any professional advisory relationship. You use all content at your own discretion and risk, and KINSTILL makes no warranty as to its accuracy, completeness, or applicability to your individual situation.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by applicable law, KINSTILL and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal or health-related outcomes, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

13. Indemnification

You agree to indemnify and hold harmless KINSTILL, its operators, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

14. Third-Party Links

The Service may contain links to third-party websites not operated by us, including payment processors and financial service providers. We are not responsible for the content, privacy practices, or terms of any third-party site, and we encourage you to review their respective policies.

15. Protection of Minors

The Service is not intended for unaccompanied minors. If you are a minor, you must obtain the prior consent of your parent or legal guardian. We reserve the right to take reasonable measures to verify the age of users and to restrict access to sensitive content, in accordance with applicable legislation on the protection of minors, including the United Nations Convention on the Rights of the Child.

16. Electronic Contracts and International Transactions

KINSTILL operates in accordance with the United Nations Convention on the Use of Electronic Communications in International Contracts (New York, 2005), to which Cameroon acceded on October 11, 2017 (effective May 1, 2018).

Electronic contracts concluded through the Service are valid and enforceable. The order confirmation and these Terms constitute a binding agreement between you and KINSTILL.

17. Consumer Protection – International Standards

KINSTILL adheres to the United Nations Guidelines for Consumer Protection (1985, extended in 1999 and 2015) and applicable regional standards, including CEMAC Directive No. 02/19 on Consumer Protection.

You have the right to clear information before purchase, the right to withdraw within the applicable period, the right to a remedy for defective content, and the right to data protection. Nothing in these Terms limits any mandatory consumer rights you may have under the law of your country of residence.

17.1 European Union / EEA Consumers

  • You have a 14-day right of withdrawal for distance contracts, unless you have expressly requested immediate access and waived your right (see Section 5)
  • Pre-contractual information is provided in accordance with Directive 2011/83/EU
  • The order button clearly indicates that placing an order entails an obligation to pay

17.2 United States Consumers

  • We comply with the Federal Trade Commission Act's prohibition on unfair or deceptive practices
  • We do not use dark patterns or misleading design
  • All material terms are disclosed before purchase

18. Cybersecurity and Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

18.1 Your Obligations

  • Use a strong, unique password
  • Enable multi-factor authentication where available
  • Notify us immediately of any unauthorized access or suspected breach
  • Not share your login credentials with third parties

18.2 Our Commitments

  • We implement reasonable security measures, including encryption, access controls, and regular backups
  • We monitor for suspicious activity and may suspend accounts exhibiting signs of compromise
  • We will notify affected users in the event of a data breach, in accordance with applicable law

18.3 Incident Response

In the event of a security incident, we will take immediate steps to isolate the affected systems, preserve evidence, reset compromised credentials, and notify relevant parties as required by law.

19. Termination

We reserve the right to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service, other Visitors, or third parties. Termination for violation does not entitle you to a refund, without prejudice to your legal remedies in the event of abusive termination.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Cameroon, without prejudice to applicable international conventions and mandatory consumer protection laws in your jurisdiction.

Any dispute arising from or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts of Cameroon, without prejudice to any mandatory consumer-protection rights you may hold under the law of your own jurisdiction. If you reside in a jurisdiction offering more favorable consumer protection, you may also bring proceedings before the competent courts of your place of residence.

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

23. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and KINSTILL regarding the Service and supersede any prior agreements.
  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights without restriction.
  • Survival: Sections concerning intellectual property, disclaimers, limitation of liability, indemnification, data protection, anti-fraud, and governing law shall survive termination of these Terms.
